Terms and Conditions for the Cheza Sita Game

PREAMBLE

HEART GAMES LLP, an organisation registered under the laws of Kenya (no. LLP-QQ1E9E) whose registered address is at: Unit 6, Diani Umbi Shopping Centre, Diani Beach Rd, Kwale, hereinafter referred to as 'HEART'.

HEART is authorized and regulated by the Betting Control and Licensing Board of Kenya (hereinafter referred to as “BCLB”) under the Betting, Lotteries and Gaming Act, Cap 131, Laws of Kenya under License number: 0000880.

All HEART games remain subject to the provisions of the Betting Lotteries and Gaming Act (Cap 131 Laws of Kenya) and any disputes arising hereunder shall be resolved in accordance with such provision.

This agreement establishes the Terms and Conditions that apply and control the contractual relationship between the Operator and the Player in relation to the HEART Game played via any media or electronic platform, including inter alia, mobile devices, tablets, laptops or computers. Each HEART Game Players are reminded that each game may also have its own set of procedures and rules that are relevant, and that they will be deemed to have accepted and be bound by any such procedures and rules. When using the services provided by the Operator, you must agree to these terms and conditions, and you are obligated to abide by them for the duration of the relationship. These Terms and Conditions set forth our business practices, how bets are accepted and settled, and what the Player can anticipate from HEART. The Player recognizes and confirms acceptance of these terms and agrees to abide and be bound by them by using our services, regardless of how they access them. If a Player does not agree to these terms of usage, he or she should cease from accessing or using our services.

This HEART Cheza Sita Game (hereinafter referred to as 'CHEZA SITA') is subject to the provisions of the Kenya Betting Lotteries and Gaming Act and as such any disputes arising hereunder may be settled in consultation with BCLB representatives.

The Terms and Conditions set out in this Agreement govern the contractual relationship that HEART has with you as a Player. The Terms shall apply to gaming via Mobile Money and USSD. When using the services provided, you must agree to the terms and conditions stated below. These Terms and Conditions apply to the whole relationship between Heart and You for the existence of the relationship. These terms and conditions are subject to change at any time and without prior notice by the Operator. All reasonable attempts will be made to notify Players of significant changes to these Terms and Conditions. Despite this, it is the player's duty to check for updates, and it is assumed that by participating, all Players have read, comprehended, and agreed to the Terms and Conditions as of the time of entry.

The Cheza Sita Game Description

Cheza Sita is a Draw-Based Game based on choosing a set of up to six numbers number - which constitutes a Bet. The pool consists of the numbers 1 to 6 inclusive. When Players enter, they can either choose their numbers or a random selection that will be generated by the system. Players can bet a variable amount between Ksh.20 to Ksh.1,000 on the outcome of the draws, which are instant draws for each entry.

With the BCLB's permission, Heart may occasionally operate extra or bonus games and jackpots at its discretion. Relevant information about these games will be made available on the website. Additional game-specific rules, restrictions, and conditions may apply to such games and jackpots

The Cheza Sita Game Method of Entry

Players can enter the Cheza Sita Game by using USSD to play.

Players can enter the Cheza Sita Game by dialling *675# to access the USSD menu. Full details for USSD entry mechanism are available here.

* All USSD entries shall be subject to Safaricom fees at the prevailing rate (currently Ksh.1).

The Player receives a result through SMS once it has been confirmed that the transaction has been accepted.

Notes:

i. Safaricom Mpesa is the Mobile Money platform currently available for use. Heart may at its discretion introduce other mobile money platforms.

ii. At the time of their first bet, new players will receive an SMS with account information and promotional messages relevant to their accounts.

iii. The Player is responsible for any Mobile Money-based transaction fees imposed by the mobile providers.

1. The Cheza Sita Game Rules

1.1 The Cheza Sita Game involves an instant random draw of up to six single-digit numbers ('Numbers') each selected from the numbers 1 to 6.

Note: The system will not accept selections of zero or above six. If a zero (0) is selected it will be automatically converted to one (1). Any digit greater than six (6) will be converted to six (6). Any non-numeric selection will result in a random selection between one (1) and six (6). Any selection that is more than six (6) digits, the additional digits will be disregarded by the system.

1.2 The Draw uses a Random Number Generator approved by the BCLB.

1.3 Each entry is subject to a different draw. The exact draw time will depend on the processing of the entries such that Heart can fulfil its obligations to the BCLB.

1.4 The Stake for each Cheza Sita Game Bet is between Ksh20 and Ksh1,000. Despite the previous default restrictions, a player may ask to opt out of the limitation requirement by getting in touch with our customer service division. In accordance with our responsible gaming standards and industry best practices, Cheza Sita reserves the absolute right to do any necessary research and to reject any such requests.

Limitation of Liability – Cheza Sita reserves the right to establish a maximum total bet for each draw on a particular entry number. If a player chooses such a number, they will be notified by SMS and will have their bet fully restored to their Mobile Money Account.

1.5 If a player deposits less than the minimum bet, Cheza Sita will keep the amount on account and send the player an SMS to let them know, and instruct them that if they pay the remaining amount, they will be entered into the subsequent draw for that particular game.

1.6 For each Cheza Sita bet, only one Prize, which will be the highest of the possible Prize Categories and applicable to that Cheza Sita bet, may be won.

1.7 The results can be checked by visiting the Site. Players who placed bets in the game will likewise receive these results.

1.8 Heart shall endeavour to ensure that the results shown on the Site or publicized via other means are accurate (including Prizes, Prize Breakdowns, and Winnings) . Heart will not be held responsible for any errors in this information even though every attempt will be taken to assure its accuracy.

2. Rules to Entry

2.1 You must have a Kenyan Mobile Money Account registered to Your Account and possess a genuine form of identification that is linked to your Kenyan mobile money account.

2.2 Each bet must be purchased for its full price, except for complimentary entries given away by Heart as part of a promotion or as prizes for Cheza Sita games.

2.3 Bets can only be made through Heart.

2.4 Your bet will only be valid if it is recorded on Heart's Computer System.

2.5 If, for some reason, Heart is unable to process your deposit and issue a bet at that time due to unanticipated technical issues or problems, Heart will process Your deposit and issue a bet for the next available draw once the issues have been resolved.

2.6 You can only bet and receive Prizes in line with these Rules.

2.7 There is no general right for a person to bet. Without giving a justification or explanation, Heart has the right to limit the number of bets You may place or refuse to accept bets from anyone.

2.8 8 Subject to Rule 2.7, the following people cannot bet and hence Heart will not be responsible to pay a Prize to them:

a) Anyone under the age of 18, whether that person is betting for themselves or anyone else

b) Partners and Employees of Heart

c) Specified employees of any of Heart's key contractors or sub-contractors

d) Personal partners and persons who are, to some extent, maintained by anyone mentioned in Rules 2.9 (b) and 2.9 (c) or in either case if living in the same household as that person

e) Anyone whose Account status prevents them from placing a bet or collecting a prize (including without limitation a person whose Account has been suspended or terminated)

f) Anyone else Heart may decide and specify in any amendment which is made to these Rules or in any other appropriately published communication from time to time.

2.10 If a Prize is paid to anyone listed in Rule 2.9, that person will be required to repay the Prize immediately.

2.11 Heart or Heart personnel may bet with the express authorization of the BCLB, but only in order to test Accounts and transactions made with Mobile Money Accounts. Any consent obtained may be subject to terms set by the BCLB, such as the prohibition on Heart personnel and Heart from receiving any benefits from any Prize won through such bets

3. Your Responsibilities

3.1 You are responsible for keeping safe and confidential any information required to claim a Prize for a particular Bet (including, for example, the relevant Ticket Number and Your Identification Information). You accept that you won't be awarded a prize if you can't give enough identification information while claiming it.

3.2 You are also responsible for:

a) Checking that Your Ticket shows the correct Bet, Games and Draw reference, and

b) Claiming (where applicable) and checking You receive the full amount of any Prize You are entitled to.

c) If there are any taxes that apply to the Prizes, Heart will subtract the appropriate sum and send it to the tax collecting organization. Where necessary, tax withholding certificates will be given to the winners.

4. Prize Terms and Rules

The Operator maintains the right to evaluate and modify the above at its sole discretion but must publish the revised conditions. Prior to participating, players are deemed to have read the most recent terms and conditions posted on the website.

5. Claiming a Prize

5.1. You can only claim a Prize if You are the holder of an Account with a Winning Bet.

5.2. Typically, Prizes up to Ksh140,000 may be paid instantly to your mobile money account. For prizes above Ksh140,000, the following rules and notes apply. If You are claiming a Prize within the Claim Period, you must make your claim using one of the following procedures:

a) Through Your Account, confirming that payment should be made to You. This must be done before 11.00pm on the last day of the Claim Period

b) Via telephone to the Customer Care Team. You must telephone during the Customer Care Team's normal opening hours which, at the time of writing these Rules, are as follows: 8.00am - 8.00pm on Mondays to Saturdays, 9.00am - 5.00pm on Sundays – reduced opening hours may apply over the Christmas and New Year Period. You are advised to refer to the Site for current opening hours.

c) In person at Heart's registered office* during Heart's normal business hours* within the Claim Period. Heart must receive sufficient information to prove You are the holder of the Account that has the Winning Entry, together with a completed Prize Claim Form, and any other form(s) or documentation that Heart request (where applicable).

*Heart's registered office is located at Diani Umbi Shopping Centre, Kwale, Kenya. Normal business hours are as follows: 9.00am to 5.00pm Monday to Thursday and 9.00am to 5.00pm on Fridays (excluding Bank Holidays). Reduced hours may apply over the Christmas and New Year period.

5.5. A Prize can be claimed in person within seven days from the end of the Claim Period if, before the end of the Claim Period, You contact Heart and notify it that You intend to claim a Prize in this way (and give Your name, address and all details of the Bet that Heart reasonably requires) and if You then present the proof of identity and any relevant completed Prize Claim Form in person at Heart's office during normal business hours (see Rule 5.4) within the seven day period. You can contact Heart by:

a) Telephoning the Customer Care Team during its normal opening hours from time to time. See above or refer to the Site for the Customer Care Team's current opening hours

b) Emailing [email protected]. Heart must receive the email before the end of the Claim Period.

c) If You fail to claim within the additional seven-day period, Your entitlement to the Prize will be lost and the Prize will not be PAID.

6. Validation Requirements

6.1. BA Prize must successfully pass validation in accordance with Heart's reasonable validation methods, which are periodically adopted, before a Prize can be paid on a Bet. The validity of the Bet shall be determined by Heart's sole and binding discretion.

6.2. Without limiting the effect of Rule 6.1, Heart will declare a Bet invalid (and will not, therefore, pay any Prize relating to that Bet) if:

a) The Bet is the outcome of an act by You or another person that was intended to improve the chances of You or that person winning a Prize in the relevant Game above the chances enjoyed by other Players of that Game, or to increase that Prize; or

b) The Bet is counterfeit, all or part of the Bet has been forged, or the Bet fails to pass Heart's validation and security checks; or

c) The Prize claim is not received within the relevant claim period set out in Rules 5.3 and 5.5;

d) The Ticket Number for the Bet is not on Heart's official list of Winning Entries, or the relevant Prize for the Winning Bet with that Ticket Number has been paid previously; or

e) The details associated with the Ticket Number of a Bet do not match Heart's official records of that Ticket Number; or

f) Heart reasonably believes that the Bet was purchased by or on behalf of a person falling within one of the categories in Rule 2.8.

6.3. Without limiting the effect of Rule 6.1, Heart may declare a Bet invalid (and will not be obliged to pay any Prize) if:

a) Heart has a reasonable belief that the person claiming the prize is not the owner of the relevant Account or their lawfully authorized agent, or that the information they have supplied is insufficient, inaccurate, or has been tampered with.

b) The Bet has not been issued or sold by Heart

c) The Ticket Number (or any other unique feature of the Bet) does not match the records on Heart's Computer System for the Game that the Bet relates to.

7. Payment of Prizes

7.1. The Information below sets out how Interactive Prizes of different amounts should be claimed and will be paid.

a) Prizes ranging in value from 'Ksh0 to Ksh140,000': Prizes and other winnings from Games in this category will automatically be deposited into Your Mobile Money Account.

b) Prizes of values of 'Ksh140,000 and Above': Prizes and other winnings in excess of Ksh.140,000 from games purchased or played on the Mobile Website must be claimed in person at Heart's Office by the Player who received the Ticket. Contact the Customer Service Center at Heart for more information. You acknowledge and agree that You will be required to comply with all Heart prize claim requirements, including confirmations of Your identity and eligibility for the prize, to the satisfaction of Heart, in its sole and absolute discretion. You will be required to provide a form of valid government-issued photo identification, as well as any other information that Heart may require in order to confirm Your eligibility for a prize.

7.2. Heart reserves the right to:

a) Pay Prizes by check, bank transfer, direct credit, or mobile money. If you payment is for a prize worth less than Ksh.140,000, it will be deposited (at Your expense) into the Mobile Money Account associated with Your Account or any other account agreed upon between Heart and You.

b) Ask You to attend Heart's Office to claim Your Prize

c) Withhold a Prize, if acting reasonably, until it is completely satisfied that a Bet is valid and the claim is made in good faith

d) If Heart decides (in accordance with Rule 11.1) that the Bet is invalid or defective, or if there is any other reason that Heart (acting reasonably) believes, in its discretion, that You (as the person claiming a Prize) are: not lawfully entitled to receipt of a Prize; or that a Prize has been paid to You in circumstances where Heart determines that the Bet is defective; Heart will swiftly conduct all checks and inquiries. You agree to pay back any money that Prize Heart requests as soon as possible.

e) Recover a Prize that was incorrectly deposited into Your Account

f) Request proof of prize eligibility (including, without limitation, Identification Information, proof of identity and capacity to claim)

g) Deny paying a prize If you cannot or do not provide enough identification information when claiming a prize.

h) Photograph anyone claiming a Prize for Heart's records

i) Request that a court decide who should receive a Prize and/or make a payment to the court

j) If You Refuse To Sign All The Paperwork Required By The Insurance Underwriters, We May Refuse To Pay A Prize.

7.3. The right to a Prize is not transferable.

7.4. Heart will not be responsible or liable to any person claiming a Prize which has been paid to a person who assumed the identity of the relevant Account.

7.5. No interest will be payable on any Prize, including without limitation: whilst any checks or enquiries are being carried out in relation to a Winning Bet; whilst a dispute about the Bet or Prize claim is being resolved; or for the period a Prize remains unclaimed.

7.6. Any charges levied by the Mobile Operators' payment gateways (Mpesa) will be deducted from Your account.

7.7. Any applicable taxes levied by the Kenya Revenue Authority will be deducted from Your account.

8. Draws and Winning Numbers

8.1. Heart will, at its discretion, decide the time, frequency, date and method of the Draws for each Game.

8.2. Each Draw will select Winning Numbers at random with the use of the Random Number Generator approved by the BCLB.

8.3. If a Draw is interrupted because of equipment failure, or for any other reason, the Draw will be completed in line with the applicable Draw Procedures for that Game. If a Draw can't take place on the date or at the time fixed, it will take place as soon as reasonably possible thereafter.

8.4. If any Game Draw is declared invalid, another Draw will take place in line with the applicable Draw Procedures to determine the Winning Numbers.

8.5. Heart will only pay a Prize based on the official results of the relevant Draw recorded in line with Rule 8.4 and electronically recorded in Heart's Computer System. Heart will not pay a Prize based on results recorded anywhere else, including for example in newspapers, winning number telephone lines, or on the Site.

8.6. Heart will not be required to make any payment against any incorrectly announced number(s) at the Draw.

9. Information about Winners

9.1. You will automatically be deemed to have granted Heart an irrevocable right to publish Your full name (as well as Your nick name), hometown, photograph, and video materials without any claim for broadcasting, printing, or other rights, for a period of up to 36 months after the date of prize award, when you claim or receive a prize. This right to publish extends to all forms of media broadcasting, including the internet. You also grant Heart permission to publish any further information that You voluntarily provide for up to 36 months following the award of the prize. You shall have no claim against Heart for invasion of privacy or on any other ground(s) by consequence of the publication or broadcasting of Your Name, hometown, photograph, video materials, or information freely submitted by You.

9.2. If You win a Prize, You understand and accept that Heart may, if required by law, provide a third party with details of any Prize claimed by You or on Your behalf, or paid to You.

9.3. By participating in the Game, You expressly agree that Heart, its agents, employees, and/or service providers may collect, use, and disclose the Participant's Personal Information for the purposes of operating and administering the Game.

9.4. You accept that Heart has the right to send you promotional messages unless You explicitly opt out.

10. Game Closures etc.

10.1. Heart may at any moment, after consulting with the BCLB, reveal the end date for a certain Game. After the deadline, no entries for that game will be sold

10.2. Heart can also (at its absolute discretion) suspend or withdraw any Game after consultation with the BCLB.

11. Limitation of Liability

11.1. Where instructed by the BCLB, Heart will, or may (in its discretion -provided it is acting reasonably), declare that a Bet is defective. In these circumstances, all relevant Entries and all relevant Prizes won will be void and Heart will either:

a) Provide You with an opportunity to place another Bet of equivalent price; or

b) Refund the amount paid for the defective Bet.

Heart will decide which of (a) or (b) above shall apply.

You do not have the right to cancel a bet. Subject to Rule 11.1 (b) and Rule 12.1, no refunds will be given in any circumstances. No interest will be payable in respect of any refunds made.

11.2. Heart will not reimburse the cost of the Bet and its only responsibility will be to pay an amount equal to the Prize that You would have been entitled to if the cancellation had not occurred. This will only apply if Heart is fully satisfied following proper and thorough consideration and inquiries that the cancellation of a Bet was entirely and directly caused by Heart's fraud, negligence, or error.

11.3. Heart's only duty is to give the owners of Winning Entries the Prizes won in any Game or, in the cases described in these Rules, to issue a refund. Other than, subject to Rule 11.4, the non-payment of a Prize or the non-payment of a reimbursement You are entitled to under these Rules, and without limiting the impact of Rules 11.1 and 11.5, Heart will not be liable for any loss of whatsoever nature. Heart will not be responsible for any loss of profits, special, indirect, or consequential losses suffered or incurred by You (or any holder or owner of a Bet, any person claiming a Prize during the Claim Period, or any other person) as a result of your withdrawal from any Game or your participation in any Game or your choice not to participate. Included in this is the fact that you were unable to take part in the Game for whatever reason.

11.4. Heart will not be liable to any person for:

a) Unforeseen circumstances (such as war, strike, lockout, industrial action, fire, storm, drought, power outage, and/or breakdown or obstruction of any network, broadcasting, or telecommunications service) that are beyond its reasonable control and expectations;

b) Failure, destruction, or damage to all or a portion of Heart's computer systems or third parties' records (including, but not limited to, the Site and/or Heart's computer system);

c) Any mistakes caused by all or part of the computer systems or records of Heart or any third party (including, without limitation, the Site and/or Heart's Computer System);

d) Delays, losses, mistakes, or omissions in or made by the postal or other delivery service, or by the banking system;

e) Anything else that would stop or impede the issuance of a legitimate Bet (including without limitation the failure of the Site to display correctly on any device used to view it);

f) The refusal to allow any person to bet or to allow any person to play a Game Played Online or via SMS or Mobile Money;

g) Any losses brought on by You, including those resulting from the abuse or unauthorized use of passwords, money lost while participating in online or SMS games, or the failure to update Heart about any changes to Your contact information;

h) Any losses brought on by the malfunction or failure of Your: internet service provider, mobile phone network operator, equipment, or technology; or by the internet service provider or mobile phone network operator of any other person or third party.

11.5. Nothing in these Rules excludes or limits:

(a) any person's liability

(i) for fraud

(ii) for death or personal injury caused by breach of any duty that person may have to take reasonable care or exercise reasonable skill

(b) any other liability which cannot lawfully be excluded or limited.

11.6. You acknowledge and agree that, regardless of whether the person is a party to these Rules, You do not rely on and will not have any recourse with respect to any statement, representation, warranty (whether made negligently or innocently), or understanding made by any person.

12. Disputes and Heart's Decisions

12.1. As long as it is a reasonable conclusion, Heart's decision regarding whether or not a Bet is a Winning Bet, or in respect to any other matter or dispute arising from the payment or non-payment of Prizes, will be final and binding (and subject to Rule 12.3). Following any such decision made by Heart, Heart may (at its discretion) repay the cost of the Bet or replace the disputed Bet with a Bet on any current Game of the same price, without restricting the impact of the preceding clause and Rule 11.1. All disagreements must be brought to the BCLB's attention, which will serve as the dispute's final arbiter.

12.2. The remedy in Rule 12.1 will be the Player's sole and exclusive remedy, and any compensation or replacement will completely release Heart from all responsibility for such a disagreement (subject to Rule 12.3). Heart won't be required to pay interest on any reimbursements made in accordance with this Rule 12.

12.3. Heart may withhold payment of a Prize and/or make an equivalent payment into court until any dispute has been resolved.

12.4. Any legal disputes will be automatically submitted to the BCLB.

13. General

13.1. Any person who bets, submits a bet slip for verification, or claims a prize in any capacity agrees to be bound by the terms of any applicable laws, the rules listed below (all of which may be updated from time to time), and any additional guidelines, statements, or explanations Heart may issue with regard to the Game Played with Mobile Money

13.2. Heart reserves the right at any time to modify these Rules, the applicable Game Procedures, and any Game Specific Rules that apply to the Games played via Mobile Money. These changes will apply to Bets placed after the date on which they take effect, as well as Entries purchased prior to that date if reasonable under the circumstances, and will be effective as of the date of their publication on the Site (or any earlier time Heart states), or on notification to You that the changes have been made. Heart may notify You via email, Account notification, post, or any other form of communication that is reasonable considered and determined by Heart. You agree that You will be bound by the changes when You next play a Game Played via Mobile Money, when you next access Your Account, when you claim a Prize after the changes have become effective, or (where relevant) when You expressly accept the changes, whichever occurs first.

13.3. If a court of the Laws of the Republic of Kenya determines that any provision (or portion of a provision) or rule mentioned above is void and/or unenforceable, that determination only applies to that specific provision (or portion of the provision) and does not, by itself, render any other provisions void or unenforceable.

13.4. Your rights and/or duties under these Rules may not be assigned or transferred in any other way, in whole or in part. Heart may immediately terminate your access to the Site and/or the use of Your Account for any violation of this rule. Heart may also assign or otherwise transfer its rights and/or obligations under these rules, in whole or in part, to any third party at its sole discretion.

13.5. You agree that when You contact the Customer Care Team, You will supply any Games-Related Information required by Heart

13.6. Privacy: The Operator will respect your right to privacy and will always take precautions to keep your information strictly confidential. The Operator, however, is not responsible for any data loss. Except when necessary to process your requests, when required by law, when necessary to enforce the Terms & Conditions, or when necessary to safeguard the Operator's rights or property, your personal information won't be disclosed to third parties. Note: a credit reference bureau may get the personal information you supply and retain a record of it.

13.7. Force Majeure: The Operator disclaims any liability for any effects brought on by significant events outside its control, including strikes, terrorist attacks, political unrest, conflicts, natural disasters, network saturation from cyberattacks, hacking, etc.

13.8. Intellectual Property: All content, including all products, logos, trademarks, service marks, trading names, and other intellectual property, is owned by the Operator, its affiliates, and third-party contractors and is protected by international intellectual property and copyright laws and regulations on our Site, SMS, Mobile service, and all other media and electronic platforms. Without the Operator's prior written consent, no portion of the Site, SMS, or Mobile service may be duplicated, stored, modified, republished, uploaded, posted, transmitted, or otherwise distributed, including text, graphics, video, messages, code, or software. Neither may it be incorporated into another website or into any public or private electronic retrieval system or service.

14. Jurisdiction

These Terms and Conditions shall govern this Agreement and the contractual relationship between you and the Operator and shall be interpreted in accordance with the laws of the Republic of Kenya, as applicable. The Kenyan courts will hear all legal proceedings.

15. Definitions

Account: An account maintained by a Player on Heart's Computer System.

BET: The entry mechanism into the game.

Heart: an Operator incorporated in Kenya.

Heart's Computer System: The computer systems used by or on behalf of Heart from time to time to operate Cheza Sita games, administer Accounts, facilitate Entries and pay Prizes.

BCLB: Betting Control and Licensing Board

Claim Period: A period of up to 30 days after the draw date.

Operator: Heart

Customer Service Team: Heart's helpline for Players. Telephone: 0111 00 55 66. Email [email protected]. Refer to the Site for the Customer Care Team's current opening hours.

Draw: The process which results in the random selection by Heart of a set of Winning Numbers for a Game.

Draw-Based Game: Synonymous with Game.

Draw Break: A point in time before a Draw after which no Selections will be entered into that Draw.

Draw Procedures: The draw procedures that apply to a Draw, as determined by Heart from time to time.

Game: The Cheza Sita game, the result of which is determined by a Draw.

Game Played via a Mobile Device: A Game, entry into which can be initiated via Mobile Money

Game Specific Rules: Any rules or requirements published by Heart in addition to or in place of these Rules, which exclusively relate to a specific online game.

Games-Related Information: Before granting you access to the games played online, Heart may request information from and/or about you, such as Your name, username, password, phone number(s), Mobile Money details, debit card details, security information, address, Identification Information, email address, date of birth, and gender.

Identification Information: Information used to prove Your identity, including information needed for Heart to validate that information's veracity. Any component of the information related to the games as well as any data or papers you submit while claiming a prize could be considered identification information. These kinds of identification are recognized: Passport, Kenyan driving license and Voter Registration ID.

Interactive Prize: A prize won by a Player from a Bet.

Lucky Pick: A selection of numbers which are randomly selected by Heart's Computer System on Your behalf for the purposes of making a Bet.

Mobile Money: Safaricom Mpesa

Player: Has the same meaning as You.

Privacy Policy: Heart's policy relating to the use and storage of Your personal information (including but not limited to Games-Related Information), as amended from time to time.

Prize: A prize that is interactive. The awarding of non-cash Prizes is included in references to the payment of Prizes in these Rules.

Prize Structure: The value of Prizes and odds of winning in an individual Game as determined by Heart and set out in the Game Procedures for the relevant Game.

Procedures: Written document provided by Heart in addition to these Rules, for a specific Game Played Online that includes the Game name, the bet, how to play, how a Prize is won, the dates and/or frequency of Draws, the Game Prize Structure, how Prize winners are determined, and any other relevant information for the Game Played Online.

Selection: A set of numbers chosen by You (whether chosen by Yourself or via Lucky Dip) for the purpose of making a Bet.

Site: The website www.heart.co.ke

Ticket: The textual or graphical representation of Your Bet.

Ticket Number: The alphanumeric reference on a Ticket that identifies a certain Bet, is specific to it, and is saved in Heart's computer system as well as, for entries purchased with your account, in your transaction history.

Validation Requirements: Heart's Entry validation requirements referred to in Rule 6 or as otherwise determined by Heart from time to time.

Winning Bet: A Bet which entitles You to a Prize and which meets all the Validation Requirements.

Winning Numbers: The numbers and/or letters used to determine the Winning Entries for a Game.

You: An Account holder who is qualified to purchase Entries using that Account and whose Account has not been closed, canceled, suspended, or terminated.

Golden Ticket Promotion

For the duration of the Golden Ticket promotion:

1. Every Cheza Sita ticket (except those purchased with Bonus Balance or Free Plays) that plays with 6 numbers ("Cheza 6") is a special GOLDEN TICKET for the duration of the campaign.

2. If you play now and do not match 6 numbers instantly, in addition to your instant play, the winning numbers from Cheza Sita are checked against your previous GOLDEN TICKETS.

3. If all 6 numbers match, you win Ksh10,000. For example, if you played Cheza Sita and the winning numbers were 234521, if these numbers match on any of your previous GOLDEN TICKETS, you win Ksh10,000.

4. The secret is to play every day to accumulate as many GOLDEN TICKETS as possible. If you don't play in 24 Hours, your GOLDEN TICKETS will be lost.

5. The payout is capped at Ksh10,000 and can only be won once in a 24 hour period.

6. The campaign can end at any time at the discretion of Heart Games.
